Kanter Conditions of Sale

The following conditions outline the terms between Kanter and both vendors and purchasers for all horse sales and auctions conducted on our platform. By participating in the Kanter auction, you agree to these terms. We encourage all users to carefully review these conditions before bidding or listing horses.

1. Submission and Listing Process

  • No Upfront Fees: Submitting your horse for auction is completely free until a successful sale is made. Upon the successful sale of a horse, a registration fee of €229 + VAT will be deducted from the final sales price.
  • Horse Information: Vendors are responsible for ensuring all information provided about the horse, including medical, pedigree, and performance records, is accurate and up to date. Misrepresentation will result in the cancellation of the sale.
  • Veterinary Documentation: We require that vendors include veterinary certificates and health certs to increase buyer confidence. Any horse sold with a veterinary certificate must undergo an inspection by an approved veterinarian.

2. Auction Process

  • Bidding: Bidding takes place through our secure platform. Once a bid is made, it is legally binding, and the highest bidder at the conclusion of the auction will be declared the purchaser.
  • Reserves: Horses may be entered with or without a reserve price. If a horse does not meet its reserve, no fees are charged to the seller. Sellers are advised to clearly communicate their reserve price prior to the auction.
  • Payment: Upon completion of a successful sale, both the vendor and purchaser will receive an invoice. Purchasers are required to settle their invoice within 3 days of the auction’s close. Failure to make payment may result in cancellation of the sale and relisting of the horse.

3. Fees and Commission

  • Vendor Fees: In addition to the deferred registration fee of €229 + VAT, a commission of 5% of the final sale price will be deducted from the seller’s proceeds.
  • Buyer Fees: Buyers are also subject to a 5% fee on the final sales price. This means Kanter’s total commission is 10%, split equally between the vendor and purchaser.
  • No Sale, No Fee: If the horse does not sell, no fees or commissions are charged to the vendor.

4. Descriptions of a Lot and Stable Vices

  • Accuracy of Descriptions: The vendor is responsible for the accuracy of all details provided about the horse. This includes, but is not limited to, information on the horse’s age, pedigree, performance history, health condition, and any veterinary treatments received. Kanter accepts these details in good faith and makes them available to prospective purchasers, but we do not independently verify the accuracy of this information.
  • Known Vices: Vendors must declare any known stable vices at the time of listing, such as crib-biting, weaving, windsucking, or box-walking. Failure to disclose any of these vices could result in the horse being returned to the vendor and the sale being canceled, at the purchaser’s discretion.
  • Medical and Behavioural Issues: Any significant medical history, surgical procedures (e.g., unnerving or tubbing), or behavioral issues (e.g., napping, difficult to load or ride) must be fully disclosed by the vendor prior to the sale. Horses sold with undeclared medical or behavioral issues may be subject to return and refund, depending on the severity and impact on the horse’s fitness for purpose.
  • Veterinary Inspection: Purchasers have the option to request a veterinary inspection within 30 minutes of the sale’s conclusion. If the horse is found to have any significant medical condition or stable vice that was not disclosed by the vendor, the sale may be voided, subject to Kanter’s decision.
  • Returnable Lots: Horses found to have a vice or medical issue that was not declared at the time of sale, such as crib-biting or impaired vision, may be returned by the purchaser. The decision to return a horse will be based on the evidence provided by a veterinarian and at the discretion of Kanter.

5. Conditions of Sale

  • Risk and Ownership: Ownership of the horse transfers to the buyer at the fall of the hammer, or after any post-sale veterinary examination, if requested by the buyer. The horse remains at the vendor’s risk until this point.
  • Post-Sale Re-Examination: Buyers may request a veterinary re-examination within 30 minutes of the sale’s conclusion. Any significant medical findings not disclosed prior to sale may render the horse returnable to the vendor.
  • Private Sales: All sales of horses listed on Kanter must be conducted through our platform. Any private sale outside of the auction process must still be registered with Kanter, and commissions will apply as per our standard terms.

6. Disputes and Liability

  • Disputes: Any disputes arising from a sale will be handled between the vendor and purchaser. Kanter will facilitate communication but holds no liability for disputes concerning the condition, performance, or description of the horse.
  • Liability: Kanter is not liable for any loss, injury, or damage to horses while they are under the control of the vendor or purchaser, nor during the transportation or stabling of the horse.

7. Withdrawals and Cancellations

  • Vendor Withdrawal: Vendors may withdraw a horse from auction up until the auction’s start. After the auction begins, any withdrawal will incur a penalty of €100 to cover administrative costs.
  • Cancellation: If the buyer fails to meet payment obligations, Kanter reserves the right to cancel the sale and relist the horse in a future auction.

8. Purchaser’s Duties

  • Registration: All purchasers must register with Kanter prior to bidding. By registering, you agree to the platform’s terms and conditions, and all bids placed will be considered binding.
  • Due Diligence: Before placing a bid, purchasers should thoroughly review all available information about the horse, including any medical documentation, photos, and videos. Since this is an online auction, it is essential that buyers ensure they are satisfied with the horse’s condition based on the provided materials.
  • Bidding: Once a bid is placed online, it is considered legally binding. Purchasers are responsible for their bids and cannot retract them once they have been submitted. Buyers should ensure their accounts are secure, as they will be held liable for any bids made from their registered account.
  • Payment: Upon the successful winning bid, purchasers are required to complete payment within 3 days. All payments are processed securely online, and Kanter reserves the right to apply penalties or cancel the sale if payment is not made in a timely manner.
  • Ownership and Risk: Risk transfers to the purchaser once the sale is finalized at the fall of the hammer in the online auction, or after the conclusion of any post-sale veterinary inspection, if requested. The purchaser is then responsible for arranging transport and care of the horse.
  • Post-Sale Veterinary Inspection: Purchasers have the option to request a veterinary re-examination within 30 minutes after the sale. If any discrepancies are found between the vendor’s description and the horse’s actual condition, the sale may be voided, subject to Kanter’s final decision.
